I suggest you ask about File:Walter Richard Cassels.jpg at c:COM:VPC and maybe also take a look at the Wikipedia articlea copyfraud and National Portrait Gallery and Wikimedia Foundation copyright dispute because I'm fairly certain that any claim of copyright authorship by the NPG for a photo taken by someone who died more than 100 years ago is just the NPG try to claim a right that courts in the UK have ruled that it doesn't have. Commons doesn't seem to have any problems hosting files like this despite the NPG's claim. -- Marchjuly (talk) 08:28, 12 May 2026 (UTC)
- @Marchjuly: Yeah, I'm aware of the Wikimedia vs NPG dispute. However, I note that COM:LICENSE also says
If material that has been saved from a third-party website is uploaded to Commons, the copyright laws of the U.S., the country of residence of the uploader, and the country of location of the web servers of the website apply.
Now, I don't live in the US or UK, and have no idea whether my country allows sweat of the brow copyright claims as asserted by the NPG, so I just went with Fair Use. If another editor wants to upload it to Commons, on their head be it. :) Muzilon (talk) 09:01, 12 May 2026 (UTC)- Just for reference, I asked about this at c:COM:VPC#National Portrait Gallery sourced photo from 1863. Moreover, I understand you being concerned about this, but again I think it should be OK. The problem with uploading the file as non-free is that, if discussed at FFD, it would likely be seen as failing WP:NFCC#1 (WP:FREER) and end up deleted because someone could upload the same photo to Commons as PD, even if you don't want to do so yourself. -- Marchjuly (talk) 05:12, 13 May 2026 (UTC)
- Actually, that's precisely what happened when I uploaded a photo of Nancy Hsueh as "Fair Use", so it wouldn't bother me if the same thing happened with Cassels. Muzilon (talk) 12:05, 13 May 2026 (UTC)
