第十条 国徽及其图案不得用于：
- 商标、广告；
- 日常生活的陈设布置；
- 私人庆吊活动；
- 国务院办公厅规定不得使用国徽及其图案的其他场合。
Article 10 The National Emblem and the design thereof shall not be used in:
(1) Trademarks or advertisements;
(2) Furnishings or ornaments in everyday life;
(3) Private activities of celebration or condolence; and
(4) Other circumstances where the National Emblem and the design thereof may not be used, as prescribed by the General Office of the State Council.
Article 13 Whoever desecrates the National Emblem of the People's Republic of China by publicly and willfully burning, mutilating, scrawling on, defiling, or trampling upon it shall be investigated for criminal responsibility according to law; if the circumstances are relatively minor, the offender shall, with reference to the provisions of the Regulations on Administrative Penalties for Public Security, be punished by the public security organ with a detention of not more than fifteen days.

Artigo 10.º O desenho do Emblema Nacional pode ser usado nos seguintes documentos e licenças:
1) Documentos de trabalho, documentos para efeitos de aplicação da lei, entre outros, de funcionários dos órgãos do Estado;
2) Licença para a exploração de actividades, certificado de autorização, certificado de aprovação, certificado de qualificação, certificado de direito, entre outros, emitidos pelos órgãos do Estado;
3) Bilhete de identidade de residente, passaporte da República Popular da China e outros documentos legais de entrada e saída.
Os emblemas dos órgãos do Estado e das forças armadas podem ter o desenho do Emblema Nacional como desenho central.
Os cidadãos podem ter aposto o Emblema Nacional em ocasiões solenes para expressar sentimentos patrióticos.
Artigo 13.º É proibido o uso do Emblema Nacional e do seu desenho em:
1) Marca, desenho que seja objecto de concessão de patente ou publicidade comercial;
2) Artigo de uso diário, mobiliário ou artigo de decoração de uso corrente;
3) Celebração ou cerimónia fúnebre privadas;
4) Outras situações previstas pela Secretaria-Geral do Conselho de Estado. (de: [4])File history
