Though this image is subject to copyright, its use is covered by the U.S. fair use laws, and the stricter requirements of Wikipedia's non-free content policies, because:

1. It is a historically significant and iconic image.

The significance of this image is that it shows the moment of the reported shooting, during which only dust can be seen, something that has caused a great deal of the controversy over whether the pair were actually shot. Commentators have asked why the camera went out of focus. In addition, it appears unlikely from this frame that it would be possible to tell where the shots had come from, yet France 2 announced that the Israelis had targeted the pair. This has been a major part of the controversy.
