1. It is a low resolution screenshot of a game;
2. It does not limit the game's copyright owner (Apogee Software) to sell the game in any way;
3. The screenshot itself is not part of the game;
4. The screenshot is significant as it illustrates the game itself and its graphics, and it helps to show how the game really is;
5. It is the only game screenshot shown in the page
