Summary
editUnder German law, photographs (Lichtbilder) are protected by copyright for fifty years after the date of first publication in the case of anonymous works or works of unknown authorship (Urheberrechtgesetz §72). Consequently, copyright on this image may have expired in October 1987.
Additionally, some works of the German government (including works created by the Third Reich), are not copyrighted under Urheberrechtgesetz §5, and are consequently in the public domain. However, this is not extended to images which have been altered, and it could be argued that this image is altered because the original is a photographic negative, whereas the image above is an electronic file.

| Purpose of use |
To illustrate the most well-known aspect of the article subject. Not only does it illustrate the individuals involved at a specific moment in time, but the ability to see visual expressions gives the viewer an indication of the parties' relationships and inter-personal dynamics. |
| Replaceable? |
No: it is a historically impossible-to-replace illustration of a significant historic event. No free equivalent is likely to come to light. It is of sufficiently low quality that reproduction will not harm the commercial opportunity of the copyright holder. |

This image shows (or resembles) a symbol that was used by the National Socialist (NSDAP/Nazi) government of Germany or an organization closely associated to it, or another party which has been banned by the Federal Constitutional Court of Germany.
The use of insignia of organizations that have been banned in Germany (like the Nazi swastika or the arrow cross) may also be illegal in Austria, Brazil, the Czech Republic, France, Hungary, Poland, Russia, Ukraine and other countries, depending on context. In Germany, the applicable law is paragraph 86a of the criminal code (StGB), in Poland – Art. 256 of the criminal code (Dz.U. 1997 nr 88 poz. 553).
